1. Acceptance of Terms

Welcome to Bitcoin Apex. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Bitcoin Apex ("Company," "we," "us," or "our") governing your access to and use of our website, mobile applications, and trading services (collectively, the "Services").

By using our Services, you represent and warrant that you meet all eligibility requirements. We reserve the right to verify your eligibility at any time and may refuse or terminate service if you fail to meet these requirements.

3. Account Registration

3.1 Creating Your Account

To access most features of Bitcoin Apex, you must register for an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your login credentials confidential and secure
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials. We strongly recommend enabling two-factor authentication (2FA) for additional security. Bitcoin Apex will never ask for your password via email, phone, or any other communication channel.

3.3 One Account Per User

Each user may only maintain one account. Creating multiple accounts may result in the termination of all accounts and forfeiture of any funds held therein.

Bitcoin Apex provides an AI-powered automated trading platform that connects users with cryptocurrency markets through regulated broker partners. Our Services include:

4.2 No Investment Advice

Bitcoin Apex does not provide investment advice, financial advice, trading advice, or any other sort of advice. All trading decisions are made by you or by the automated trading system based on your configured parameters. You should consult qualified financial advisors before making any investment decisions.

4.3 Service Availability

While we strive to maintain uninterrupted service, we do not guarantee that our Services will be available at all times. We may suspend, withdraw, or restrict the availability of all or any part of our Services for business, operational, legal, or regulatory reasons.

5. Trading Risks

By using our Services, you acknowledge and accept the following risks:

• Market Volatility: Cryptocurrency prices are highly volatile and can change rapidly and unpredictably
• Loss of Capital: You may lose some or all of your invested funds
• Technology Risks: Trading systems may experience delays, failures, or errors
• Regulatory Risks: Laws and regulations regarding cryptocurrencies may change
• Liquidity Risks: You may not be able to exit positions at desired prices
• Algorithmic Trading Risks: Automated systems may not perform as expected under all market conditions

Past performance is not indicative of future results. You should never invest more than you can afford to lose.

6. Fees and Payments

6.1 Deposits

The minimum deposit to begin trading is ₹20,000 (or equivalent in other currencies). We accept various payment methods including UPI, bank transfers, and card payments. Deposit processing times vary by payment method.

6.2 Trading Fees

Our fee structure is transparent and competitive. Specific fees may include:

• Trading commissions on executed trades
• Spread costs (difference between buy and sell prices)
• Overnight holding fees for certain positions

All applicable fees will be clearly disclosed before any transaction is executed.

6.3 Withdrawals

Withdrawal requests are typically processed within 24 hours. There are no hidden withdrawal fees. Minimum withdrawal amounts and processing times may vary depending on your chosen payment method.

7. User Conduct

When using Bitcoin Apex, you agree NOT to:

• Violate any applicable laws or regulations
• Engage in fraudulent or deceptive practices
• Manipulate markets or engage in wash trading
• Use automated systems to access our platform without authorization
• Attempt to gain unauthorized access to our systems or other users' accounts
• Transmit viruses, malware, or other harmful code
• Harass, abuse, or threaten other users or our staff
• Use our Services for money laundering or terrorist financing
• Impersonate any person or entity
• Collect personal information about other users without consent

Violation of these conduct rules may result in immediate account termination and forfeiture of funds.

8. Intellectual Property

All content, features, and functionality of Bitcoin Apex—including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and the compilation thereof—are the exclusive property of Bitcoin Apex or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any materials from our platform without our prior written consent.

9. Privacy

10. Disclaimers

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

Bitcoin Apex does not warrant that:

• The Services will function uninterrupted, secure, or available at any particular time or location
• Any errors or defects will be corrected
• The results of using our Services will meet your requirements
• The quality of any products, services, information, or other material obtained through our Services will meet your expectations

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BITCOIN APEX, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Services
• Any conduct or content of any third party on the Services
• Any content obtained from the Services
• Unauthorized access, use, or alteration of your transmissions or content
• Trading losses or missed trading opportunities

12. Indemnification

You agree to defend, indemnify, and hold harmless Bitcoin Apex and its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

13. Termination

13.1 Termination by You

You may close your account at any time by contacting our support team. Upon closure, you must withdraw any remaining funds within 30 days.

13.2 Termination by Us

We may suspend or terminate your account and access to the Services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination:

• Your right to use the Services will immediately cease
• We may retain your data as required by law
• Any outstanding obligations will survive termination

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Services.
